Whitehall Officials Ordered to Pay Thousands

An Allegheny County judge has ordered members of Whitehall Borough Council to pay nearly $9,000 each to the borough for improperly awarding contracts to companies who were not the lowest bidders.

In a decision released Wednesday, Common Pleas Judge Timothy P. O'Reilly found that the seven council members violated the borough code in awarding three contracts in 2003. O'Reilly ordered each of them to pay the borough the difference between the lowest bids and the price of the bids that were awarded.

The charges above the lowest bidder for the three contracts totaled $62,635 -- and are to be split among the council members Harold Berkoben, Linda Book, Kathleen DePuy, Phillip Lahr, Robert McKown, Glen Nagy and Robert Wotus.

The lawsuit was filed by resident Franco Moscatiello. His son, Antonio Moscatiello, owns Osiris Construction Co., which was the lowest bidder for projects in two of the cases. Council denied the projects to Osiris because they were not satisfied with an earlier job he had done, according to the opinion.
