On Monday, the Law Offices of Daniel Feder filed a racial discrimination and harassment lawsuit against the County of Sacramento on behalf of four African-American employees of the County's Kiefer Landfill. According to the lawsuit, the employees discovered a black mannequin with a noose around its neck at a landfill worksite last year. The employees are Michael Walton, Earl Sallie, and Willie Jones, three equipment operators currently employed with the County, and Lewis Scott, a landfill supervisor who has since left his employment with the County. The employees are represented by the Law Offices of Daniel Feder in San Francisco, California.
The complaint alleges that African-American employees of the County landfill have been subjected to racial discrimination and harassment for many years, including denial of promotions, assignment to the most physically punishing and undesirable work at the landfill, sabotage by their white counterparts, the use of racist language by their supervisors, the display of Ku Klux Klan imagery, and the lynching of a black mannequin. The complaint further alleges that African-American employees have been physically assaulted at the landfill and threatened with violence.
According to the complaint, the County has largely ignored the complaints of African-American employees at the landfill, including complaints about the black mannequin. The complaint alleges that the workplace became increasingly hostile after the mannequin incident, forcing one of the plaintiffs, Mr. Scott, to quit his position.
According to Daniel Feder, the attorney representing the plaintiffs, "The County's conduct manifests what our clients consider to be callous indifference to the right of African-Americans to work in an environment free from harassment and discrimination based on race." The plaintiffs are seeking damages for emotional distress and wages lost due to the alleged discrimination and harassment.
