Wisconsin Supreme Court Upholds State Property Tax Exemption for Wisconsin Airlines

MILWAUKEE, July 7 /PRNewswire-FirstCall/ -- In a 5-2 decision, the Wisconsin Supreme Court has upheld a state property tax exemption for airlines operating hub facilities in Wisconsin.

The case was an appeal of a 2003 ruling by a Dane County Circuit Court that invalidated the exemption; that ruling came in a case brought by Northwest Airlines. The Wisconsin Legislature originally enacted the exemption in 2001 to stimulate investment and encourage economic development by creating a tax environment for airlines that was equitable with tax environments in surrounding states.

The decision means airlines that provide certain levels of nonstop service to and from Wisconsin will be exempt from paying state property taxes on aircraft and associated equipment. Both Midwest Airlines and Air Wisconsin qualified for the exemption in 2002.
