MTA Admits Liability Prior to Opening Statements in Negligence Trial Where Bus Passenger Was Severely Injured

WHAT: At 9:30 AM on Friday, June 1, 2007, Browne Greene will give his opening statement in Joseph L. Garcia's negligence lawsuit against the Los Angeles County Metropolitan Transportation Authority (MTA) in Los Angeles Superior Court/West Division (Santa Monica Courthouse), Department "I", 1725 Main Street, Santa Monica, CA. 90401 before the Hon. Jacqueline A. Connor. Earlier today (May 31, 2007), the MTA admitted liability in the case, and it remains for the damages portion of the case to be tried. Joseph L. Garcia v. Los Angeles County Metropolitan Transportation Authority, Case No. SC088830.
The trial began on Friday, May 25, 2007 and is expected to last about one week. Mr. Garcia is represented by Browne Greene and Geoffrey S. Wells with the Santa Monica, CA. law firm of Greene Broillet & Wheeler, LLP and Kenneth E. Ostrove. Mr. Garcia filed suit on March 3, 2006.
WHO: On June 25, 2005, Joseph L. Garcia (now age 58) was a passenger on an MTA bus driven by Sylvia Delana Fairfax that was traveling on Santa Monica Boulevard in Santa Monica, CA. when the bus collided with a vehicle parked on the northbound side of the street, causing him to violently strike his head within the interior of the bus. As a result, Mr. Garcia suffers from permanent injury to his brain, among other serious injuries. He now requires 24-hour attendant care for the rest of his life and the Court appointed a conservator to handle his financial affairs.
"We are ready to try the damages portion of Joseph Garcia's case," stated Browne Greene. "Although it is good that the MTA admitted liability for destroying Mr. Garcia's life, it still remains unconscionable that the MTA rejected our earlier settlement demands of $29 million and that it has even put Mr. Garcia through the ordeal of a trial. We will do everything in our power to see that justice is served."
