San Marcos School District Files for Eminent Domain

May 5--SAN MARCOS ---- The San Marcos Unified School District filed for eminent domain in Vista Superior Court on Tuesday in order to proceed with the construction of its 11th elementary school, according to district officials.
The school district plans to begin construction on a 52,335-square-foot school dubbed "Future Elementary No. 2" on Oleander and Mimosa avenues in Vista by Oct. 1.
The school board voted unanimously Apr. 24 to use eminent domain to acquire the land for the $21 million school set to open in August 2007.
Eminent domain was pursued after a lawsuit was filed against the district seeking to stop construction of the school by a community group named Parents for Safe Schools and property owners Oleander Partners Inc.
