Pierson was on the first big tour with his band Subtle, and had recently received recognition from Rolling Stone Magazine. He and the band had already backed mega stars like Beck on recent albums. As a composer, keyboardist and vocalist Dax had begun to score movies, notably four songs for the film "Dark Heart."

At trial Ford denied negligence asserting that the accident was the driver's fault.
