New York, NY (PRWEB) March 15, 2012
The New York injury lawyers of Barasch McGarry Salzman & Penson, in partnership with Kreindler & Kreindler continue to stand by the heroes of 9/11, pledging not to abandon any World Trade Center first responder clients. As reported by the New York Post, the Worby Groner Edelman Napoli Bern Law Firm (WGENB) has advised its clients that it is unable to represent them for claims under the federal Victim Compensation Fund (VCF) that was reopened by the Zadroga Act. Barasch and Kreindler have teamed up to offer their combined experience and resources to assist any former WGENB client who was injured or sickened by exposure to the Ground Zero toxic dust and air.
Barasch McGarry lawyers have recovered close to $1 billion on behalf of over 1,500 first responders from the original VCF. Likewise, Kreindler & Kreindler has recovered hundreds of millions of dollars from the first VCF of behalf of their clients. Barasch McGarry partner Michael Barasch and Noah Kushlefsky, a partner at Kreindler & Kreindler, meet frequently with WTC VCF Special Master Sheila Birnbaum to advocate of behalf of the WTC first responder community. As proud members of the Feal Good Foundation legal team, they lobbied Congress to pass the Zadroga Act and are now helping the Department of Justice draft the rules so that they are as fair as possible.
The 2010 Zadroga 9/11 Health and Compensation Act was named in honor of first responder James Zadroga, an NYPD detective who died from a respiratory illness caused by inhaling WTC toxic dust. Congress has provided $4.2 billion of funding for healthcare and compensation benefits earmarked for those who became sick or disabled, and to families who lost loved ones because of exposure to Ground Zero toxins.
The partnership of Barasch and Kreindler have assured Special Master Birnbaum that the clients transferred by WGENB will not have to obtain their medical records again, nor will they be charged any fees for the seamless transfer of their files.
According to Michael Barasch, “WGENB´s clients should ask any prospective attorney one question — how much experience did you have handling VCF cases when the first Fund was open from 2001-2003? Too few attorneys understand how much work goes into preparing a claim properly to ensure that the victim gets what he or she is entitled to.”
The most common illnesses covered by the Zadroga Fund include asthma, chronic obstructive pulmonary disease (COPD), interstitial lung disease, and more. The Barasch and Kreindler partnership is also fighting to have cancer included as a covered injury.
