Seattle Attorney Chris Davis Helps Drunk Driving Victim Get Fair Compensation for Traumatic Brain Injury

The names of the parties are being withheld due to a confidentiality provision demanded by the insurance carrier involved in the litigation.

Court documents indicate that the collision occurred when a vehicle driven by a drunk driver crashed at a high speed. The driver was found to have been legally intoxicated, and had a blood-alcohol reading well above the legal limit of 0.08.

Davis Law Group represented the passenger that was injured in the drunk driving crash. According to court records, the victim sustained multiple fractures including a mild traumatic brain injury. The driver and the passenger were returning home after drinking at a local restaurant. The driver later pleaded guilty to driving under the influence of intoxicating liquor.

Davis, a strong supporter of tougher drunk driving laws in Washington State, was successful in negotiating the $2M settlement on behalf of the drunk driving victim after several months of litigation, court records show. The defendants argued that the passenger was more than 50% at fault for consuming alcohol with the driver and then deciding to ride with an intoxicated driver.

According to Mothers Against Drunk Driving (MADD) one in three people will be involved in an alcohol-related crash in the course of a lifetime, with alcohol-induced accidents claiming 10,839 lives each year — or one every 50 minutes. Furthermore, the average arrested drunk driver has driven while intoxicated 80 times on average before being convicted.

In Washington State, 42% of all fatal motor vehicle crashes involve a driver that was under the influence of alcohol. In 2009, over two hundred people in Washington State lost their lives in drunk driving crashes. Recently, the Washington State Legislature voted to increase the criminal penalties for drunk drivers who cause fatality accidents by increasing jail terms and monetary fines.
