New York Medical Malpractice Lawyer David Perecman Weighs in on Dental Negligence Lawsuit Filed by LeAnn Rimes

New York medical malpractice lawyer David Perecman discusses dental negligence following the filing of a high-profile lawsuit by LeAnn Rimes. Singer Rimes is suing her dentist for dental work that, among other things, compromised her ability to perform.

Singer LeAnn Rimes filed a dental negligence lawsuit against her dentist, Dr. Duane C. McKay. Allegedly, he misdiagnosed her dental problems and gave her substandard dental care. Dental negligence is an often overlooked area in medical malpractice law, said New York medical malpractice lawyer David Perecman.

“Many people don´t know that, like doctors and hospitals, dentists can be liable for medical malpractice, as well,” said Perecman.

Rimes is suing McKay for dental work he carried out between December 2009 and April 2012. Among her complaints, she was given veneers that were of a “poor shape, size and color” which the dentist later replaced with crowns. The dentist´s actions caused Rimes “severe tooth pain, gum inflammation and chronic gum bleeding,” said the lawsuit.    

She has needed eight faulty crowns removed, one tooth extraction, bone grafting, and nine root canals to correct the dentist´s mistakes, added the lawsuit.

In the lawsuit, Rimes claimed she was left with a “permanent cosmetic deficiency” and that problems related to Dr. McKay´s work affected her “ability to perform as an artist.”

“Patients can suffer permanent injuries and long-term pain as a result of dental negligence,” said Perecman, founder of The Perecman Firm. “Individuals deserve compensation when medical malpractice leads to serious dental injury.”

Rimes is seeking unspecified damages for psychological and emotional damage, pain and suffering, medical expenses, and loss of earnings, said the lawsuit.

The singer canceled a number of performances last summer to undergo emergency root canal treatment, reported ABC News (2.14.13).
