Bernstein Liebhard LLP notes that the U.S. Judicial Panel on Multidistrict Litigation (JPML) heard Oral Arguments yesterday regarding the proposed consolidation of all federally-filed Mirena IUD lawsuits in a single federal court for pretrial proceedings. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434 (JPML)) According to a Reuters report, more than 40 Mirena lawsuits have been filed in federal courts around the country, all of which allege women suffered serious Mirena side effects, including uterine peforations and device migration.    The idea of a multidistrict litigation was proposed by Mirena plaintiffs, with some supporting transfer of the cases to federal courts in Ohio, New York or Pennsylvania. However Bayer Healthcare Pharmaceuticals, which markets the Mirena IUD, is opposed to any consolidation of federal claims, Reuters said.*

Mirena Lawsuits

According to Reuters, all of the Mirena IUD lawsuits currently pending in federal courts allege the label for the Mirena IUD failed to adequately warn that the device could spontaneously migrate from the uterus leading to serious complications. The complaints further claim Bayer has a history of overstating Mirena´s benefits and understating its significant risks. While Bayer is opposed to the idea of a federal consolidation for Mirena lawsuits, the company did recently request that all Mirena claims filed in state court in New Jersey be consolidated in a single proceeding in Middlesex County Superior Court. However, the New Jersey Supreme Court rejected that request in January.*

The Mirena IUD was approved by the U.S. Food & Drug Administration (FDA) as a birth control method in 2000. In 2009, Mirena´s approved uses were expanded to include treatment of heavy menstrual bleeding in women who wish to use an IUD as their method of birth control. The small, plastic t-shaped device is inserted into the uterus by a healthcare provider, where it may remain for up to 5 years. In 2009, the FDA issued a warning letter to Bayer after finding that its Mirena promotions overstated the efficacy of the device and minimized the risk of Mirena side effects. Among other things, the FDA took issue with marketing claims touting Mirena´s purported ability to improve a woman´s sex life and help her “look and feel great.” According to the FDA Mirena warning letter, at least 5% of Mirena IUD users reported decreased libido in clinical trials.**
