Bernstein Liebhard LLP notes the scheduling of the next case management conference in the federal litigation of Biomet hip replacement lawsuits established in the U.S. District Court, Northern District of Indiana. According to a Memorandum issued by the Court on March 20, the status conference will be held April 22nd at 9:30 a.m. Claims filed in this multidistrict litigation were brought on behalf of patients who allege injuries stemming from the metal-on-metal Biomet M2a Magnum hip implant. The last status conference in this litigation was held March 18th and discussed a range of issues related to the Biomet M2a Magnum hip replacement, according to the Memorandum. Production of electronically stored information and modifications to the Plaintiffs´ Fact Sheet were among the items addressed.

Biomet Hip Replacement Lawsuits

The Biomet M2a Magnum hip implant is a metal-on-metal hip consisting of a metal femoral head and pelvic cup made of chromium and cobalt. Given the high number of adverse event reports filed with the U.S. Food and Drug Administration (FDA) over metal-on-metal hip implants, the agency proposed a new rule in January that would make this class of devices ineligible to receive market approval via the FDA´s 510(k) clearance process. This approval process allows a product to bypass human testing if the manufacturer can prove it to be substantially equivalent to one already on the market. The agency also issued a new recommendation that patients who received metal-on-metal hip implants consider metal ion testing if they are experiencing symptoms associated with early hip failure.*

Court records indicate there are at least 141 Biomet hip lawsuits pending in the litigation established in the U.S. District Court, Northern District of Indiana. These claims allege the Biomet M2a Magnum hip replacement can cause patients to suffer injuries related to high levels of metal ions, which may lead to metallosis in the surrounding tissue and blood, as well as early failure of the device.
