Wright Conserve hip replacement lawsuits continue to move forward in a federal multidistrict litigation now underway in U.S. District Court, Northern District of Georgia, Bernstein Liebhard LLP reports. On May 15th, the Court issued the litigation´s Second Amended Detailed Discovery Plan, which will govern discovery in the proceeding. Among other things, the Plan directs the parties to submit bellwether trial selections by October 18, 2013, and stipulates that all expert discovery in the Wright hip lawsuits will conclude by November 15, 2013. All of the Wright hip lawsuits pending in the Northern District of Georgia allege use of the Wright Conserve Total Hip Implant System, Conserve Total A-Class Advanced Metal Hip Implant System, and the Conserve Resurfacing System resulted in the accumulation of excessive metal ions in recipients, many of whom were forced to undergo revision surgery. In a regulatory filing dated April 30th, Wright Medical Group reported that additional Conserve hip replacement lawsuits had been filed in state court in California, a number of which have been consolidated for pretrial handling pursuant to procedures of California State Judicial Counsel Coordinated Proceedings.*
According to a Joint Notice of Settlement filed with the U.S. District Court, Northern District of California, on March 20th, a settlement has been reached in one lawsuit involving the Wright Profemur hip replacement. (Tucker, et ux. v. Wright Medical Technology, Inc., et al., No. 4:11-cv-03086) In its April 30th filing, Wright Medical warned that last year´s Stryker hip recall for Rejuvenate and ABG II hip stems could potentially affect sales of its Profemur modular-neck stems. The Company noted that the Stryker recall has increased industry focus on the safety of cobalt chrome modular neck products, such as the Profemur hips.*
