According to court documents, the issue hinges on whether a particular expert will be able to testify at trial. Plaintiffs in DePuy Pinnacle lawsuits filed in the federal litigation established in the U.S. District Court, Northern District of Texas allege the all-metal version of the DePuy Pinnacle Hip Replacement System, which includes an Ultamet liner, caused them to suffer metallosis and other painful complications indicating early hip failure. DePuy Pinnacle Lawsuit Claims

According to a Master Case List update issued by the Northern District of Texas on June 3rd, 2013, 4,246 DePuy Pinnacle lawsuit claims had been filed in the federal proceeding. These claims were filed by patients allegedly injured by the all-metal version of the Pinnacle hip. Complications associated with this device are allegedly caused by its potential to wear out, which in turn may cause metallic debris to shed into the patient’s blood stream.

Less than a month before this Case List update was posted, Johnson & Johnson announced its plans to halt sales of the all-metal version of the DePuy Pinnacle hip replacement, as well as other metal-on-metal hip devices currently manufactured by DePuy Orthopaedics. The company’s decision to end sales of its metal-on-metal hip replacements was published in a May 16th report from the New York Times.* In citing its reasons for stopping sales of these devices, the company stressed that its decision did not signify a DePuy Pinnacle recall and was prompted by lower sales demands, as well as the U.S. Food and Drug Administration (FDA)’s recent proposal to institute new regulations for approving metal hip implants.

According to the new regulations proposed by the agency in January 2013, all manufacturers of this class of devices would be required to conduct safety and efficacy studies on their products in order to continue selling them. Thus, metal-on-metal hip replacements would become ineligible to receive approval via the FDA’s 510(k) process, which allows a device to bypass human testing.**
