One year after the announcement of the Stryker hip recall for Rejuvenate and ABG II hip stems, Stryker hip lawsuits continue to move forward in both state and federal courts. According to court documents, a Case Management Conference was held on June 18, 2013, in New Jersey’s Bergen County Superior Court, where scores of Stryker hip claims have been consolidated in a Multicounty Litigation. Following the Conference, Superior Court Judge Brian R. Martinotti issued an Order that, among other things, addressed several discovery related issues, including the depositions of witnesses who are in extremis, and procedures for written discovery. Stryker Hip Lawsuits

Stryker recalled its Rejuvenate and ABG II hip stems in July 2012, after the metal components were found to be prone to fretting and corrosion at the modular neck junction. According to a recall notice issued by Stryker at the time, recipients of the Rejuvenate and ABG II components are at risk for a number of serious complications, including pain, swelling and adverse local tissue reactions. All patients with these hip implants have been advised by the company to undergo blood tests for elevated metal ion levels and cross sectional imaging to ensure their hips are functioning properly, even if they have not suffered any problems associated with this recall.*

According to court records, at least 160 Stryker hip lawsuit claims have been filed in New Jersey Superior Court. In April, Judge Martinotti set forth procedures for the parties to begin selecting cases for early mediation. However, his order stipulated that the Stryker hip recall litigation will continue while mediation takes place.

Federal court documents indicate that dozens of Stryker hip lawsuits have also been transferred to a multidistrict litigation now underway in U.S. District Court, District of Minnesota. The U.S. Judicial Panel on Multidistrict Litigation’s June 12th Transfer Order initially sent 41 Stryker hip lawsuits to that proceeding, though the Panel noted that 110 potentially-related claims pending in various federal district courts could also be eligible for transfer.
