As da Vinci robot lawsuit claims continue to be investigated by Bernstein Liebhard LLP, the Firm notes that the debate surrounding the safety and efficacy of robotic surgery continues to grow. According to a report published by the Tribune-Review on July 6th, the University of Pittsburgh Medical Center (UPMC), which owns eight da Vinci Surgical Systems, has chosen not to heavily market its robotic surgery services. In an interview with the Tribune-Review, UPMC’s chair of Urology, Dr. Joel Nelson, pointed out that there is no significant difference in outcomes between robot-assisted prostatectomy and standard procedures. Last year, Dr. Nelson published a study questioning the cost of robot-assisted prostate surgery that revealed that, on average, UPMC had lost more than $4,000 on each such procedure.*

Da Vinci Robot Lawsuits

The da Vinci Surgical System was brought to market in 2000 by Intuitive Surgical, Inc., and is the only robotic surgery platform approved in the U.S. for soft tissue procedures. According to the Tribune-Review, the device was used in more than 400,000 minimally invasive surgeries last year, but is also the subject of a growing number of da Vinci robot lawsuits. The U.S. Food & Drug Administration (FDA) is also reviewing reports of robotic surgery complications, including five deaths, in da Vinci surgeries.* On July 9th, Bloomberg.com reported that sales of the da Vinci robot had fallen to $215 million in the second quarter of 2013, compared with $229 million during the same period last year. One analyst interviewed for that report said the drop-off was likely due to hospitals “starting to re-evaluate treatment plans and taking a more cautious approach."**

The last few months have been difficult ones for Intuitive Surgical. On May 8th, the company sent an Urgent Medical Device Notification to its customers after determining that micro-cracks in some EndoWrist monopolar scissors used with the da Vinci could cause surgical burns, an issue which resulted in a redesign of the instruments.*** On May 30th, the FDA issued a 483 letter to Intuitive Surgical after an agency inspection of its headquarters revealed that the company had not informed the FDA about reports of da Vinci complications that caused the company to issue a cautionary letter to its customers in October 2011 .****
