Stryker Hip Recall Litigation Moves Forward in New Jersey with Issuance of New Order, Bernstein Liebhard LLP Reports

The Stryker hip recall litigation underway in New Jersey’s Bergen County Superior Court continues to move forward, Bernstein Liebhard LLP reports. According to an Order dated July 17th, the parties have reached an agreement regarding the preservation of possible future claims against Stryker entities not currently named as defendants in the Multicounty Litigation, but that may be asserted as such at a later date. Stryker Hip Lawsuits
According to court records, 161 Stryker hip lawsuit filings are pending the New Jersey litigation. All of the lawsuits allege plaintiffs suffered serious injuries, including metallosis, necrosis, osteolysis and premature device failure, due to the propensity of the Rejuvenate and ABG II stems to fret and corrode at the modular neck junction. Court documents indicate that an additional 159 Stryker hip lawsuits have also been transferred to a multidistrict litigation now underway in U.S. District Court, District of Minnesota. According to Stryker, patients fitted with Rejuvenate and ABG II stems may be at risk for adverse local tissue reactions characterized by pain and swelling around the hip joint. However, some asymptomatic patients have reportedly also experienced adverse local tissue reactions. Stryker is now advising all patients with the affected implants to undergo medical screening to ensure their hips are functioning properly, regardless of their symptoms. *
The Stryker hip recall was announced in July 2012, and involved some 20,000 Rejuvenate and ABG II hip stems. According to The Wall Street Journal, Stryker disclosed yesterday that it had taken a $170 million charge to cover expenses incurred as a result of recalled products, including the Rejuvenate and ABG II hip stems.**
