According to a Master Case List issued by the Court on August 2, 2013, 4,616 DePuy Pinnacle lawsuits have been filed in the federal litigation, all of which allege the all-metal hip caused patients to experience significant complications due to its propensity to shed dangerous amounts of metal ions into the tissue surrounding the implant, as well as the blood stream. Claims pending in the federal litigation involve a version of the Pinnacle hip system that utilizes the Ultamet liner. According to DePuy Pinnacle lawsuits, this version of the hip implant allegedly suffers from similar design flaws seen in the DePuy ASR hip implant, which was subject to a recall in August 2010. Johnson & Johnson’s DePuy Orthopaedics unit voluntarily recalled those devices because of an unacceptably high premature failure rate. Plaintiffs in DePuy Pinnacle hip lawsuits question whether the all-metal Pinnacle should have been recalled as well.
According to a New York Times report published on May 17th, DePuy Orthopaedics has decided to phase out sales of metal-on-metal hip implants. In doing so, the company cited slowing sales, as well as recent actions by the U.S. Food & Drug Administration (FDA) regarding all-metal hips.* On January 17th, the FDA proposed new regulations that would subject such devices to greater regulatory scrutiny, including a rule that would require the manufacturers of metal-on-metal hips currently on the market to conduct post-market safety studies of those products in order to keep selling them. The FDA also warned that the metal debris shed from such devices may cause serious complications, including adverse local tissue reactions, premature device failure, and other long-term health consequences.
