Da Vinci Robot Lawsuit News: Bernstein Liebhard LLP Comments on New Study Being Touted by Intuitive Surgical to Back Use Of Da Vinci Surgical System

November 5, 2013

The Firm is potential investigating da Vinci robot lawsuit claims on behalf of robotic surgery patients who allegedly suffered surgical burns, torn blood vessels, organ perforations, and other serious complications in surgical procedures involving the da Vinci Surgical System.

New York, New York (PRWEB) November 05, 2013

As da Vinci robot lawsuit (http://www.badrobotsurgery.us/) filings continue to mount in courts around the country, Bernstein Liebhard LLP notes Intuitive Surgical, Inc., the maker of the da Vinci Surgical System, is touting a newly published study that finds benefits in the use of robotic surgery to remove diseased lung tissue. According to a report from MassDevice.com, Intuitive Surgical announced the results of the study on November 4th, proclaiming that it had found that robotic procedures resulted in lower death rates, shorter hospital stays and fewer complications compared to open procedures.*

“As MassDevice.com points out, the research only compares robotic surgery to open procedures, and does not discuss laparoscopic alternatives. It is also important to point out that a number of other studies published in recent months have raised questions about the efficacy, cost effectiveness, and safety of other types of robotic procedures. The fact remains that the overall benefits and risks of robotic surgery still need further evaluation,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm is currently offering free da Vinci lawsuit evaluations to anyone who may have suffered serious injuries, including surgical burns, torn blood vessels, and organ perforations, in procedures involving the da Vinci Surgical System.

Intuitive Surgical disclosed last month that it is now named in at least 50 da Vinci lawsuits, all of which allege serious, and in some cases, fatal injuries due to the da Vinci Surgical System. The company also stated that it had reached tolling agreements to suspend the statute of limitations in certain cases, stating they were intended to provide “the parties and their legal counsel with additional time to evaluate the claims, and to explore whether the claims have merit and whether they can be resolved without litigation.”** (Cook v. Intuitive Surgical Inc., No. 12-6363 (N.D. Calif.))

Over the past year, a number of studies have raised questions about the safety and efficacy of robotic surgery. For example, Bloomberg.com reported in September that research published in Obstetrics & Gynecology found that robotic hysterectomy is not associated with reduced rates of complications, and may even double a patient’s risk of developing pneumonia.*** In August, a study published in the Journal of Healthcare Quality suggested that da Vinci complications may be underreported to the U.S. Food & Drug Administration (FDA).**** In February, a study published in the Journal of the American Medical Association reported that the costs associated with robotic surgery hysterectomy was more expensive compared to other methods, with little difference in complication rates.*****

In July, the FDA issued a warning letter to Intuitive Surgical after agency inspectors determined the company hadn’t adequately reported device corrections and patient adverse events in some cases. Most recently, Bloomberg.com revealed that reports of robotic surgery complications had doubled in the first eight months of this year, compared with the same period last year. ******

Individuals who suffered surgical burns, torn blood vessels, organ perforation, or other serious complications allegedly due to the da Vinci Surgical System may be entitled to compensation for medical bills, lost wages, pain and suffering, and other damages.
