Hundreds of Stryker hip lawsuits (http://www.strykerhiprecallclaims.com/) involving recalled Rejuvenate and ABG II Modular-Neck hip stems continue to move forward in a multicounty litigation underway in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to court documents, the Court issued a new Implementing Order on October 23, 2013 pertaining to the Defendant Fact Sheet to be used in the proceeding. Among other things, the Order directed the parties in the Stryker hip recall litigation to meet and confer to determine an appropriate schedule for the rolling production of Defendant Fact Sheets. Court documents indicate that at least 433 Stryker hip lawsuits were pending in the New Jersey litigation as of October 23rd. All of the lawsuits filed in the proceeding allege that fretting and corrosion of the metal components caused plaintiffs to suffer a variety of serious complications, including metallosis, adverse local tissue reactions, necrosis, osteolysis, and failure of the hip, often resulting in revision surgery to replace the device. According to court records, a small number of Stryker lawsuits filed in Bergen County have been selected for early mediation, and the Court has directed that a mediation session be held no later than December 15, 2013.
Court documents filed in U.S. District Court, District of Minnesota, indicate that at least 346 additional Stryker hip recall claims involving similar allegations have been filed in that jurisdiction. Rejuvenate and ABG II hip stems were subject to the Stryker hip recall on July 6, 2012, after post-market surveillance data indicated the components were vulnerable to fretting and corrosion at the modular-neck junction. According to Stryker, metal ions released due to this process could cause recipients of Rejuvenate and ABG II hip stems to experience pain, swelling and adverse local tissue reactions which may require revision surgery to replace the failing hip. Stryker has advised all Rejuvenate and ABG II recipients to undergo blood testing and cross sectional imaging, regardless of their symptoms, to ensure the hips are functioning properly.*
