Stevens' Attorneys Seek Mistrial Again

Defense lawyers for U.S. Sen. Ted Stevens, R-Alaska, renewed their request for a mistrial, claiming they've found more evidence of prosecutorial misconduct.
In a motion filed Sunday, Stevens' attorneys said material they received Friday at the order of U.S. District Judge Emmet G. Sullivan revealed what they said was "intentional misconduct" by the Justice Department to conceal information that would have helped prove Stevens innocent of charges that he failed to report more than $250,000 in gifts and home renovations on Senate financial disclosure forms, The New York Times reported Monday.
Sullivan is expected to rule by Monday night on the latest defense request for a mistrial or dismissal, CNN reported.
Stevens, the longest-serving Republican in the Senate, is seeking re-election in November.
Sullivan criticized the government for failure to disclose a summary of an FBI interview in which the prosecutors' key witness, Alaskan oil businessman Bill Allen, said Stevens would have paid any bills if they were sent to him. Allen's oil services company handled renovations to Stevens' home in Alaska.
In their latest request, defense attorneys said they learned that prosecutors interviewed again Allen allegedly to get a more damaging statement.
