He is the co-lead counsel in the Multi-District Litigation for Yaz/Yasmin birth control filed in U.S District Court, Southern District of Illinois (MDL No. 2100). Together with other co-lead counsel on the case, Michael Burg and his colleagues have reviewed “millions of pages of documents and taken 110 depositions” in a Yasmin side effects MDL that remains in play despite Bayer Pharmaceuticals’ apparent attempts to avoid trial and settle out of court.
With thousands of cases alleging Yaz blood clots and other grievous Yaz side effects, there is still a lot of settling left to do. And few are more qualified than Burg, founding partner of the law firm, Burg Simpson.
There is much at stake according to Burg. The synthetic hormone drospirenone, according to an FDA directive this past April, carries a two to three-fold increased risk of blood clots compared with oral contraceptives without drospirenone. “We believe that the product is no more effective than other birth control pills that are significantly safer,” Burg says. Drospirenone side effects also allegedly include the risk of hyperkalemia, which can result in cardiac arrest.
Bayer is alleged to have targeted young women with marketing campaigns claiming Yasmin birth control, and Yaz, had the power to mitigate PMS (premenstrual symptoms) and help control acne. Such claims led the Food and Drug Administration (FDA) to respond with a warning letter to Bayer in October, 2008. However, Yaz and Yasmin still delivered sales of $1.5 billion in 2010 for Bayer, according to a Bloomberg report (4/13/12).
As Burg notes, claims that Yaz could control acne and bloating persuaded plaintiff Carissa Ubersox to give Yaz a try, only to suffer a massive double pulmonary embolism. Slipping into a coma, Carissa’s heart stopped and she was left blind at age 24. Ubersox´s case was highlighted as part of an ABC News investigation (10/14/11).
So far about 1,800 Yasmin blood clot lawsuits have been settled at a cost to Bayer of over $400 million. “Those settlements have roughly averaged over $200,000 per case,” says Burg. “I can’t tell you if that number is accurate or not, but what I can tell you is that most of the catastrophic cases have not been settled yet.
“So, we would think that more seriously injured women would get settlements in excess of those numbers.” Other side effects include Yasmin DVT (deep vein thrombosis).
While the Yaz MDL is still in force, Bayer has requested a mediator in an attempt to settle some of the cases–a request granted at the judicial level.
Where this all winds up remains to be seen, according to Burg.
But one thing is certain. “Both Yasmin and Yaz are still on the market,” Burg says. “The warnings have been changed, even though they are not sufficient.
“Almost certainly, women continue to be injured by Bayer’s controversial birth control pill.”
