N.L. Premier Says Health Authority Can't Win Lawsuit Over Faulty Cancer Tests

ST. JOHN'S, N.L. - Newfoundland Premier Danny Williams says an embattled provincial health authority facing a class-action lawsuit over botched breast-cancer testing is sure to lose the case in court.
Williams, who stressed Monday he was speaking as a lawyer and not as premier, said he was hoping the matter could be settled out of court.
"In my opinion, there is liability here down the line through Eastern Health for the problems that have arisen here," Williams told reporters.
He was referring to the health authority at the centre of a public inquiry that is looking into why almost 400 breast-cancer patients were given inaccurate results on their hormone-receptor tests between 1997 and 2005.
The inquiry is also looking into whether Eastern Health or any other responsible authorities responded to patients and the public in an appropriate and timely manner.
"My preference is not to see these people put through any further anguish," Williams said.
The lawsuit, which will be heard by the Newfoundland Supreme Court, does not specify damages and none of its allegations have been proven in court.
