Today, SEIU United Healthcare Workers-West Filed Unfair Labor Practice Charge Against John Muir Medical Center

Posted on: Monday, 13 February 2006, 21:00 CST

OAKLAND, Calif., Feb. 13 /PRNewswire/ -- Today, hospital workers represented by SEIU United Healthcare Workers-West (UHW) filed an unfair labor practice charge with the National Labor Relations Board, Region 32, against their employer, John Muir Medical Center. Within the last six months immediately preceding the filing of the charge, management at John Muir Medical Center, Concord Campus, interfered, coerced, intimidated, and restrained employees from exercising their rights to engage in protected Union activities. The charge was also filed after months of bad faith bargaining by John Muir management during contract negotiations.

According to the unfair labor practice charge, management at John Muir Medical Center -- Concord Campus violated labor law when they:

-- Refused to set reasonable dates and times for bargaining; -- Explicitly failed and refused to respond to relevant and necessary information requests made by the Union -- Provided misinformation and/or lies in response to various information requests -- Directly dealt with the Union's members over terms and conditions of employment which the parties have put on the table during negotiations -- Managers have ordered employees and Union representatives to stop distributing Union literature in employee break rooms, which is in direct conflict with a longstanding past practice; -- Managers have threatened to discipline Union activists if they do not stop distributing Union literature in employee break rooms; -- Managers have imposed totalitarian restriction on Union activists, prohibiting Union activists from mentioning the Union in break rooms and other non-patient care areas, or face discipline
