Weight Center Wins Suit: Plano Surgery Center Lawyer Predicts That Court Will Toss Ruling

Feb. 15--A Dallas County jury has returned a nearly $1 million verdict in favor of New You Weight Management Center of Dallas, finding that Plano Surgery Center committed fraud and failed to live up to its contract with the company.
The unanimous verdict was handed down last Friday.
In January 2003, New You entered into an oral contract to organize and promote seminars showcasing PSC's specialized surgeries, including lap band weight-loss surgery, according to the suit.
The surgery center then refused to compensate New You for its work, the suit said.
"New You spent a considerable amount of time and money to help promote PSC and received almost nothing in return," said Geoffrey Harper, a partner in Dallas' Fish & Richardson PC and New You's counsel.
PSC's failure to compensate New You for its work left it without cash to pay employees and other expenses, eventually forcing it out of business, the suit said.
"It's our belief that the contract was not an arrangement that was allowed by law," said Charles Sartain, an attorney with Looper Reed & McGraw in Dallas and PSC's counsel.
"We expect the court to throw the verdict out."
