Irvine Attorney Larry Eisenberg Appointed As Lead Counsel for Former Patients in UCI Liver Transplant Litigation

At the first Status Conference held today in the UCI Liver Transplant Litigation at the Orange County Superior Court, attorney Larry Eisenberg was appointed as lead counsel for plaintiffs who are suing UCI Medical Center. The claims include negligence, fraud and misrepresentation that occurred at the now defunct UCI Liver Transplant Program. Eisenberg will coordinate the efforts of the attorneys for former patients and families of patients who never received a life-saving liver transplant at UCI Medical Center.

"Approximately 50 cases will be consolidated in this action against UCI Medical Center. This will allow the depositions of physicians and administrators to proceed so testimony regarding negligence, fraud and misrepresentation is preserved on the record under oath. The common facts that link the cases include that patients were denied vital information regarding the floundering transplant program at UCI," said Eisenberg. The patients and their families allege UCI failed to disclose the following: 1. UCI was rejecting donor livers that could have been used for designated patients on the transplant list; 2. UCI had insufficient transplant surgeons and staff and did not perform the minimum number of liver transplants required by federal guidelines; 3. The survival rate for patients transplanted at UCI was below minimum acceptable federal standards.

The Irvine law firm of Eisenberg & Gray LLP is currently representing more than 30 former UCI patients and families affected by the UCI liver transplant scandal. Eisenberg & Gray is the only law firm in California who has already litigated two liver transplant cases against UCI over the last two years. As Liaison Counsel for UCI Fertility Clinic patients, Eisenberg previously negotiated a $10 million settlement against UCI in 1997, regarding fertility doctors who stole patients' eggs without consent.
