U.S. District Court Rejects Preliminary Injunction Against Community MTM Services Inc.

ALEXANDRIA, Va., Jan. 2 /PRNewswire-USNewswire/ -- After hearing three full days of testimony and evidence, a United States District Court in Iowa quickly and completely denied a Motion for Preliminary Injunction filed by Outcomes Pharmaceutical Health Care against the National Community Pharmacists Association and Community MTM(SM) Services Inc. Indeed, the Court concluded that the Motion "must be denied." The Court concluded that Plaintiff Outcomes had failed to establish the fundamental and required elements of its claims for breach of contract, misappropriation of trade secrets and trademark infringement and that, in any event, failed to show any damage, harm or injury.
