Focus Action Encouraged By Parental Notification Ruling; High Court's Ruling Demonstrates 'A Refreshing Touch of Restraint'

COLORADO SPRINGS, Colo., Jan. 18 /U.S. Newswire/ -- Focus on the Family Action Senior Analyst for Bioethics Carrie Gordon Earll issued the following statement in response to today's unanimous ruling by the U.S. Supreme Court, ordering a lower court to reconsider New Hampshire's law requiring parental notification for a minor seeking an abortion:
"The Court today showed a refreshing touch of restraint in its ruling on New Hampshire's parental-notification law. The justices respected the law of the state and the right of parents to know if their minor daughter will have an abortion.
"Another hopeful aspect of this ruling may prove to be the language used by the court in its decision. This language indicated that the court may be moving toward a narrower definition of 'the health of the mother' -- one that would apply only to a woman's physical health.
"Abortion activists have long used this 'health' loophole to justify their frequent attempts to bend legal restrictions to the breaking point, by twisting it to include 'mental' or 'emotional' health. If prudent interpretation succeeds in closing this loophole, it will mark an important shift in subsequent abortion cases, particularly the federal partial-birth abortion ban that is currently pending Supreme Court consideration."
