SaveTownLake.Org Wins Important Court Ruling

Today a Travis County District Judge denied the City of Austin's attempt to dismiss SaveTownLake.org's lawsuit against the City of Austin for violation of the Texas Open Meetings Act. SaveTownLake.org contends that the City illegally changed the City's Land Development Code in 1999 by adopting a "Plain English" re-codification that was represented to the public as "non substantive" when in fact material elements of the original Waterfront Overlay Ordinance were omitted without proper public notice or hearings.

SaveTownLake.org's attorney, Bradley B. Clark, argued at Tuesday's hearing that the City continues to maintain that the 1999 Ordinance does not do what SaveTownLake.org says it does. At one point in Tuesday's hearing, Mr. Clark showed the judge the 1986 ordinance and the 1999 ordinance and showed the court that height limitations were in fact omitted from the 1999 Ordinance. The City's attorney did not respond.

SaveTownLake.org filed suit against the City to re-instate these height limitations to preserve the historic Town Lake Corridor.

Tom Cooke, Vice President of SaveTownLake.org, said "The City needs to quit using legal road blocks and delay tactics when it is clear the City made serious misrepresentations to the citizens of Austin. While the City recently reinstated part of what was omitted--the citizens' right to appeal--there remain many key provisions of the 1986 ordinance that for reasons I can't understand, the City refuses to correct." Mr. Cooke went on to say that "The Mayor and members of the City Council need to take responsibility and correct the situation now."
