Groups Sue EPA Over Plant’s Permit

Rocky Mountain Clean Air Action and WildEarth Guardians filed a lawsuit Friday against the Environmental Protection Agency, alleging the agency failed to overturn a state-issued air pollution permit for the aging Cemex cement plant near Lyons.

The group announced that it is suing the EPA for “failing to limit harmful nitrogen oxide pollution from the smokestack of the cement plant.”

The lawsuit alleges that Boulder County is in violation of federal health limits for ozone emissions.

Cemex spokeswoman Jennifer Borgen said the charges in the lawsuit are false.
