Ohio Strikes Down City's Gun Ban in Parks

The Ohio Supreme Court ruled 4-3 Thursday against a city's attempt to ban guns in public parks.
The could ruled that bans like the one adopted in the city of Clyde violate Ohio's concealed carry law, which allows guns to be carried in public places with only a few specific exceptions, the Cleveland Plain Dealer reported Thursday.
Attorneys for Clyde had argued that the ban on guns in city parks was permissible under the "home rule" powers outlined in the state's constitution.
However, Justice Terrence O'Donnell wrote in the majority opinion that the ordinance did not qualify under the rule because it would also affect non-residents of the city visiting the parks. He also wrote the ban conflicts with the state's gun law because it would outlaw activities that are allowed by state legislation.
