ABA Section of Environment, Energy, and Resources Readies for Conference

Up-to-the-minute information on leading environmental issues, including the future of environmental law under a new Supreme Court, the impact of Congress' controversial new energy bill, and the growing debate over efforts to find and exploit natural gas and oil on our nation's public lands, including the Alaska Wildlife Refuge, will be explored at the American Bar Association Section of Environment, Energy, and Resources' 13th Annual Fall Meeting, Sept. 21 - 25 at the Renaissance Nashville Hotel in Nashville.
Seminars will feature unique discussions of environmental developments by government officials, including representatives from the Department of Justice and Department of the Interior, industry leaders, and leading environmental lawyers.
Among the featured conference speakers are James L. Connaughton, chair of the Council on Environmental Quality under President George W. Bush, and James Gustave Speth, dean of Yale University's School of Forestry & Environmental Studies and former chairman of the CEQ under President Jimmy Carter. Speth will open the meeting on Sept. 22, speaking on the dangers of global warming, the science behind forecasts of global change, and the need for immediate action to prevent irreparable damage from global warming. Connaughton will present the Bush administration's views, not only on climate change but on the full range of environmental issues.
Other conference highlights include:
* Constitutional Environmental Law in a Time of Transition - Today, nearly three in four federal environmental law cases involve constitutional issues. This panel will discuss recent developments, including implications of Gonzales, Attorney General, et al. v. Raich, et al.
* Energy Update - Participants will discuss significant developments in 2005 in legislation, regulation and litigation affecting the power industry and American consumers.
* Oil and Gas Flashpoints: Onshore, Offshore and Alaska - Panelists will discuss current oil and gas activities and proposals for further development, and analyze the many legal and regulatory issues that grow out of these debates.
* Water, Property Rights and Endangered Species - The Legacy of the Tulare Lake Decision - This panel will focus on these issues and on whether the Tulare Lake case and its progeny represent a significant precedent on the taking aspects of endangered species law.
* Making Power in the 21st Century - TVA Takes on the Tough Issues - The Tennessee Valley Authority has been instrumental in the economic development of the Southeast. This program will provide an inside look at how TVA is responding to new challenges.
* CERCLA Litigation After Cooper v. Aviall - A panel of experts from the Department of Justice, industry and academia will explore the legal and practical implications of the Cooper v. Aviall decision and its aftermath.
* Blackout!-Can It Happen Again? - Speakers from the Federal Energy Regulatory Commission, the electrical industry and environmental organizations will discuss what has been done to prevent a recurrence of wide-ranging blackouts, such as the Aug. 14, 2003, event.

Registration costs are $710 for general attendees; $690 for ABA members; $635 for members of the ABA Section of Environment, Energy, and Resources; $435 for government and public service lawyers and academics; and $160 for law students.
