The fate of the leasing exemption won't he known for several months.

Midwestern states have launched a regional effort to jointly produce model electronic equipment recycling fee legislation. The endeavor builds on a model developed by Northeast states and includes verbatim the leasing exemption found in that model legislation. Opposition to the leasing exemption has arisen and the final outcome may not be known until several months into 2006.

The drafting of regional model legislation moves developments toward a national solution that is the ultimate goal of ELA. As the process expands, different states and regions have introduced varied systems and proposals. The marketplace is being given an opportunity to expose weaknesses of some and promise of others. States are learning in the process that equipment lessors are unique in the electronic equipment market and that this distinction must be recognized when electronic waste recycling legislation is considered.

State legislatures across the country are gearing up to debate recycling fees and who should pay them. To receive email updates on these electronic waste-recycling fee activities send your name along with that of your company in a request to dbrown@elamail.com

ELT thanks ELA Vice President, State Government Relations Dennis Brown for this month's column.
