Judge Sends Lawsuit to Avery's Home County

Mar. 24--Chilton -- A Calumet County judge ruled Thursday that a wrongful death lawsuit filed Teresa Halbach's family against Steven Avery must be heard in Manitowoc County because that is Avery's home county.

Halbach lived in Calumet County but was killed at Avery's home in Manitowoc County, authorities say.

Madison attorney Dean Strang, who is representing Avery in the wrongful death lawsuit and defending him against homicide charges in Halbach's death, had filed several motions in the lawsuit.

After determining that the lawsuit must be heard in Manitowoc County, Calumet County Circuit Judge Donald Poppy ruled that the other pending legal issues be decided a Manitowoc County judge after the case is moved there.

Avery, 43, and his nephew, Brendan Dassey, 16, are charged in the raping and killing of Halbach on Oct. 31. Halbach, a 25-year-old photographer from Hilbert, had come to the home on a job for Auto Trader magazine to photograph a vehicle that Avery said he was selling.

The next hearing in Avery's criminal case is April 13. A hearing for Dassey is May 4. Both are in Manitowoc County.
