Statement From the Association of California Water Agencies on Proposed Court Ruling Regarding State Pumping Operations

ACWA has released the following statement from Executive Director Steve Hall regarding the Alameda County Superior Court Judge Frank Roesch's proposed ruling that the California Department of Water Resources lacks the proper permits to run a key station that pumps water from the Sacramento-San Joaquin River Delta into the California Aqueduct:

"We are disappointed with the court's proposed ruling and believe the court has interpreted the statute narrowly and has not properly accounted for the state's intent to comply with the spirit of the law.

"We are distressed that it has been left to the courts to create de facto water policy in a piecemeal fashion that has the effect of disrupting our economy and our quality of life. This decision is just the latest illustration as to why our political leaders must overcome parochial interests and address the long-standing conflicts in the Delta in a comprehensive way.

"We cannot continue business as usual. We must change the system. Two out of every three Californians rely on the Delta for drinking water. This decision jeopardizes the water supply for more than 25 million Californians in Southern California, the San Francisco Bay Area, as well as five million acres of farmland. Our economic engines in Southern California and the Silicon Valley depend on a reliable supply of water from the Delta to fuel our state's trillion dollar economy.

"We are confident that the Department of Water Resources and the Department of Fish and Game will act quickly and decisively to address this problem so our water supply is not at risk."
