A Miami judge ruled Browns receiver Donte Stallworth may work out with a strength coach while under house arrest, agreeing it was part of his job.

Circuit Judge Dennis Murphy granted Stallworth’s motion, which will allow him to stay in shape while sitting out the indefinite suspension the NFL handed him after he pleaded guilty to running over a pedestrian while driving under the influence.

Stallworth’s lawyer said in a motion that remaining in peak condition was part of being a professional athlete.

The Miami Herald said Wednesday that prosecutors opposed the motion, saying that since Stallworth was not being paid, he was not technically working.

Stallworth remains on the Cleveland roster and met with Commissioner Roger Godell last week to see about returning.
