Cell Tower Lease Advisor Notified to Cease Use of Vertical Consultants’ Name in Online Ad

Vertical Consultants announces the unauthorized use of the company’s and President’s name by Comserve in their online ads and details steps being taken to rectify the issue.

Vertical Consultants, a Nashville, Tennessee based telecom consulting firm, was made aware last week that a cell tower lease advisory firm is currently using both Vertical Consultants, LLC´s trade name as well as Vertical Consultants´ President´s name “Hugh Odom” without authorization from either party. The online advertisements are being used by the Atlanta, Georgia based cell tower lease advisory firm, Comserve.

The online advertisements are structured so that potential clients of Vertical Consultants looking for more information on the company or its President will click on ads such as “Vertical Consultants-Need a Fair Lease Rate For a Tower? Or “Hugh Odom-Have Questions About Your Lease?” in the belief that they will be directed to either Vertical Consultants website or a source of more information about Mr. Odom, when in reality they are being misdirected to the Comserve website that provides neither. These advertisements are readily viewable on search web portals such as AOL and search engines such as Google.

Neither Vertical Consultants nor its President, Hugh Odom, are associated or affiliated with Comserve or any of its affiliated companies, or those companies´ owners or leadership.

Vertical Consultants has made several attempts both by written correspondence and phone calls to notify Comserve and one of its principal members, David Espinosa, of its unsanctioned use of both the Vertical Consultants trade name as well as its President´s personal name in their online ads. To date Comserve has neither terminated the use of such advertisements nor responded to Vertical Consultants attempts to resolve this matter.

Hugh Odom, the President of Vertical Consultants, states, “We are disappointed in the actions of Comserve and are working to eliminate any confusion that may result from Comserve´s attempted to garner business from not only the use of the Vertical Consultants brand but my name as well.”

Vertical Consultants and Hugh Odom have engaged its legal counsel to explore all remedies available related to both the immediate cessation of unauthorized use of both the company´s and its President´s name as well as the loss of business resulting from the actions of Comserve.

Odom adds, “Vertical Consultants has worked, since its inception, to build a name as a true property owner advocate when it comes to telecom leasing matters and, the results we have obtained to date for our clients, are allowing us to do just that. We are frustrated that certain companies are taking advantage of our efforts to further their own objectives. If these companies want to mirror Vertical Consultants, we welcome them to establish programs like ours that donate a portion of fees they earn to local charities. Vertical Consultants´ charitable initiative is potentially being negatively impacted by actions like Comserve´s that not only re-direct potential clients from Vertical Consultants but possibly devalues the Vertical Consultants brand.”
