According to Boston.com, a Massachusetts teenager and her parents should receive more than $100 million, including interest, from Johnson and Johnson and its McNeil-PPC Inc. subsidiary. A Plymouth Superior Court (Case number: PLCV2007-00064) jury ruled in favor of Samantha, a 7-year-old at her time of injury, who suffered a life-threatening drug reaction which resulted in the loss of most of her skin.
According to Brad Henry, Samantha’s attorney, Samantha battled toxic epidermal necrolysis, a rare side effect that was attributed to her use of Motrin, which led to blindness, brain damage, and irreparable damage to 90 percent of her skin,. Searing her respiratory system, the disease has left her scarred inside and out. She is still unable to utilize 80 percent of her lung capacity.
Tom Kiley Sr., Personal Injury Lawyer, has represented countless Massachusetts injury victims. According to Tom, products that result in catastrophic injuries and deaths are more common than most would like to believe.
“Defective products resulting from improper labeling or haphazard manufacturing have contributed to countless injuries and deaths. In cases such as Samantha´s, the medical expenses and pain and suffering that resulted cannot be compensated. From the age of seven until well into her teenage years, she has had to endure a level of pain that few of us will ever have to experience and the treatment that she needs will most likely last several years into her future.”
“When manufacturers produce products, they have a responsibility to make them relatively safe for the public to use. When they fail to do so, those who have suffered as a result have the right to pursue compensation for their injuries. We take pride in providing our clients with legal representation that they can rely on, because when you enter the courtroom with multi-million dollar corporations, you need defect lawyers who have the will and the means to obtain justice at any cost,” said attorney Kiley.
The jury awarded $6.5 million to each of Samantha´s parents and $50 million in compensation to Samantha herself. The McNeil unit, Johnson & Johnson´s subsidiary, did not agree with the verdict and may pursue additional legal options.
“The Reckis family has suffered a tragedy, and we sympathize deeply with them. A number of medicines, including ibuprofen, have been associated with allergic reactions and as noted on the label, consumers should stop using medications and immediately contact a healthcare professional if they have an allergic reaction, it said in a statement.
