Since the FDA issued its warning, thousands of women have filed lawsuits seeking compensation for alleged vaginal mesh complications. According to an Order dated March 9th, four transvaginal mesh lawsuits have been selected for the first bellwether trials in the C.R. Bard litigation underway in the Southern District of West Virginia, with the first to begin in June. The U.S. Food & Drug Administration (FDA) is currently reviewing the safety of transvaginal mesh used in pelvic organ prolapse (POP) and stress urinary incontinence (SUI). In July 2011, the agency revealed that it had received more than 2,800 reports of serious complications associated with the use of transvaginal mesh to treat POP. In September of that year, an FDA advisory panel recommended that pelvic mesh used for transvaginal repair of POP be reclassified as a high-risk medical device. This would make the products ineligible for 510(K) approvals, which do not require that a medical device undergo human testing if the product is “substantially equivalent” to a previously-approved device.
