Johnson Comments on Escobar Sentence After Killing 10-Month-Old Daughter
Jose Escobar was sentenced after killing his daughter and injuring his pregnant wife in an accident involving drinking and driving. DWO Attorney, Dane Johnson said the punishment could have been worse.
Houston, TX (PRWEB) September 06, 2013
After an accident involving Jose Escobar driving 100 mph with his 10-month-old daughter and pregnant wife in the vehicle, a sentence was given. Escobar will spend 4 to 12 years in prison, even though the Assistant District Attorney Patricia Brosco recommended 6 to 18 years according to Newsday.
Escobar was driving under the influence, which led to an accident killing his daughter and seriously injuring his pregnant wife, Marie Guillen. The accident occurred in July of 2012 and resulted in the vehicle colliding with the back of a 7-Eleven in Brentwood according to Newsday (7.23.13).
Escobar was more than three times the legal blood-alcohol limit of .08 percent when the accident occurred. He was driving down the wrong side of the road and tried to claim his wife was driving after the accident according to Newsday.
"With an accident like this there could have been multiple other injuries and fatalities involved," comments Johnson.
Newsday reported that Brosco spoke up for the child after sentencing because the mother of the child wouldn't. She addressed the court and said, "Helen's mother speaks only for the defendant. Her mother did not protect her when she allowed the defendant to drive drunk at speeds of up to 100 mph."
Escobar will have to live with more than just the punishment of 4 to 12 year sentence for aggravated vehicular homicide and other charges.
Johnson states that he lost his daughter due to his negligence and will live the rest of his life knowing he's responsible for taking her life. His attorney stated that he is remorseful and Escobar begged his family for forgiveness.
"Drinking and driving can have serious consequences, as Jose Escobar has found out," says Dane Johnson, Houston DWI Attorney. "Without a skilled attorney, the punishment could have been much worse."
