Spansion Files Multiple Petitions With The U.S. Patent Office Challenging Validity Of Macronix’s Patent Claims
Petitions Directed To All Patent Claims Asserted By Macronix In ITC Investigation No. 337-TA-909
SUNNYVALE, Calif., July 21, 2014 /PRNewswire/ — Spansion Inc. (NYSE: CODE), a global leader in embedded systems solutions, today announced it has filed petitions with the U.S. Patent and Trademark Office’s Patent Trial and Appeal Board (PTAB) to invalidate the patents that are being asserted against Spansion by Macronix International Co., Ltd. and Macronix America, Inc. in an investigation, No. 337-TA-909, that is currently pending at the U.S. International Trade Commission (ITC).
In its petitions, Spansion challenges the validity of three patents – U.S. patent numbers 6,552,360, 6,100,557 and 6,002,630. These patents address technologies directed to circuit designs and circuit layouts, which have long been known and used in the semiconductor industry. The PTAB’s decision on granting these petitions is expected in early 2015.
Macronix recently announced the filing of a law suit against Spansion in Germany. One of the patents asserted in this case is the European counterpart of the ’557 patent which is the subject of one of the invalidity-related petitions filed with the U.S. Patent Office today; thus, Spansion has done much work analyzing the invalidity of this patent. In response to this newly filed case in Germany, Ali Pourkeramati, senior vice president of strategic alliances at Spansion, commented, “This is yet another desperate attempt by Macronix to bring this litigation into a new forum. We are confident we will prevail in all forums.”
