HP Wins Suit Against Pelikan
Hewlett-Packard has announced that the Cologne Regional Court in Germany has found Germany-based supplier of ink and printing products Pelikan Hardcopy Deutschland to be in violation of competition law.
HP said it filed the suit last summer after Pelikan refused its request to cease its misleading advertising that claimed HP’s newly manufactured cartridges were “remanufactured” products. The court has now ordered Pelikan to cease labeling newly manufactured inkjet print cartridges as such.
In August 2007, HP said Pelikan Hardcopy had admitted to infringing its patent with the Dusseldorf Regional Court in Germany. Based on this admission, the court also ordered Pelikan to stop importing and distributing the infringing cartridges and to pay damages to HP.
