The Lanier Law Firm Announces Settlement, Judgment in Cloud Computing Patent Lawsuit

MARSHALL, Texas, Nov. 20 /PRNewswire/ -- The Lanier Law Firm is announcing a settlement and federal judgment issued in favor of inventor Mitchell Prust in a patent infringement lawsuit over cloud storage and cloud computing technology that allows individuals to access computer applications through Internet browsers.
The judgment signed Nov. 19, 2009, by Judge T. John Ward in the U.S. District Court for the Eastern District of Texas found that McKinney, Texas-based NetMass Inc. infringed three different online storage and computing patents owned by Mr. Prust, including U.S. Patent No. 6,714,968; No. 6,735,623; and No. 6,952,724. The judgment also includes a permanent injunction that orders NetMass to cease the company's infringement of the three patents in the future.
Christopher D. Banys, who leads The Lanier Law Firm's Intellectual Property Litigation Group, represented Mr. Prust along with firm founder Mark Lanier and firm attorney Hogene Choi. Attorneys from the Tyler, Texas, law firm of Ireland, Carroll & Kelley served as local counsel for Mr. Prust.

Mr. Prust invented the methods covered in each of the three patents, and filed applications for all three in February 2000. The three patents also are the subject of another pending lawsuit filed by Mr. Prust against computer giant Apple Inc. That case, Mitchell Prust v. Apple Inc., No. 2:09-cv-92, is pending in the U.S. District Court for the Northern District of California. The case against NetMass is Mitchell Prust v. Softlayer Technologies, Inc., et al., No. 2:09-cv-236.
