Newport Controls Files Complaint Seeking Declaratory Judgment Against Balboa Water Group
IRVINE, Calif., April 28 /PRNewswire/ — Newport Controls, LLC filed a complaint today against Balboa Water Group, Inc. seeking declaratory judgments of patent non-infringement and invalidity in the United States District Court for the Central District of California in Los Angeles. In the complaint, Newport Controls asserted that the company’s development and sales of a new and improved spa system do not infringe four patents owned by Balboa–United States Patent Nos. 5,361,215, 5,550,753, 5,559,720, and 7,030,343–and that claims of those patents are invalid.
Newport Controls has recently begun to sell a revolutionary spa system. As stated in the complaint, Balboa “has been contacting Newport Controls’ actual and potential customers with threats to sue them and Newport Controls for patent infringement arising from Newport Controls’ spa system.”
