Suburban attorneys opposed to O'Hare International Airport's expansion claimed the Federal Aviation Administration has not fully addressed airport funding and repeated its position that expansion would harm the suburbs, according to court documents filed Monday.
Suburban attorneys argued against the FAA's decision that allowed Chicago to begin construction before giving final approval for federal funds.
Legal documents stated that the suburbs would lose jobs and homes. And that there would be the destruction of a religious and historic cemetery, St. Johannes in Bensenville.
The FAA did not return phone calls.
A panel of judges will not decide whether to lift the injunction or keep it in place since all sides have weighed in on the matter, said Elk Grove Village Mayor Craig Johnson.
Attorneys representing Elk Grove Village, Bensenville and religious groups filed an emergency injunction more than two weeks ago.
Just hours after the FAA had given Chicago the go-ahead to begin construction, the group obtained a temporary halt after Chicago had begun moving dirt in sites north of the airport.
In the following days, Chicago and the FAA filed their own documents, asking that construction be allowed to continue.
Both the FAA and Chicago claimed the petitioners' case was not strong enough to succeed. The FAA has indicated in previous legal documents that it intended to grant Chicago federal funds for the airport.
Documents also said the opposition groups, by preventing the airport's expansion, were hurting national interests, which depend upon efficient air travel.
Chicago has proposed a $7.1 billion project for a western terminal and six parallel runways. Additionally, associated improvements bring the entire project to more than $14 billion.
The project requires more than 400 acres in parts of Chicago, Des Plaines, Elk Grove Village and Bensenville.
