Toshiba Wins Patent Suit Against Hynix

Mar. 24--TOKYO -- The Tokyo District Court on Friday ruled in favor of Toshiba Corp. in the Japanese electronics maker's patent infringement suit against the Japanese unit of South Korea's Hynix Semiconductor Inc. over its flash memory-related patents.
The court ordered Hynix Semiconductor Japan Inc. to discontinue the sale of products in violation and pay 7.8 million yen in damages.
In November 2004, Toshiba filed a lawsuit against Hynix Semiconductor Japan, seeking 290 million yen in damages for violation of its flash memory patents and an injunction against the sale of offending products.
Toshiba also lodged a lawsuit against Hynix Semiconductor in the United States and brought a complaint to the U.S. International Trade Commission.
In Friday's ruling, the Tokyo court concluded that Hynix Semiconductor Japan had chalked up 784 million yen in sales of products that violated the patents between July 2004 and June 2005, ordering the Japanese unit to pay 1 percent of the sum in damages.
In January, meanwhile, the Japanese government levied a punitive import duty on random access memory chips made by Hynix Semiconductor on the grounds that the products were priced unfairly low under subsidies from the South Korean government.
